Requirements for a valid California will:

• Testator is 18+
• Testamentary intent
• Testamentary capacity
• Signed by the testator
• Witnessed by two adults present at the same time (with limited exceptions for holographic wills)

Can a will be changed?

Yes — by codicil or by creating a new will, each signed with the same required formalities.

What if someone dies without a will? California intestate succession laws determine who inherits.
Out-of-state wills

California typically recognizes wills validly executed in another state but specific provisions may conflict with
California law (e.g., community property rules).

Does a will need to be “read” to the family?No. This is a Hollywood myth.
